General conditions of sale

 

The general terms and conditions of sale are to define the contractual relationship between the Mineral DG site and the client. They define the terms of order, payment, delivery, and possible product returns. The customer, defined as a user of the Mineral DG site, acknowledges that they are aware of these terms and conditions of sale and accepts them unconditionally.

It also recognizes that acceptance of these terms and conditions of sale does not require a handwritten signature of this document. As a result, any order of products implies the final and irrevocable agreement of the customer of all these terms of sale.

Moreover the customer declares to have full legal capacity to accept these terms and conditions of sale. In the event that the client is not legally capable of contracting, including unemancipated minor children, the client must obtain the authorization of their legal representative prior to any order.

The customer can freely and at any time access these conditions of sale by clicking on the " terms of sale" link and can freely edit or save them under his sole responsibility.

The control socket

When the customer wishes to place an order, he will be asked, following instructions provided by the site, to complete a form. It will be requested information such as its name, first name, postal coordinates, telephone and email address allowing its identification and delivery of the product(s) ordered.

The "double click" requested in view of the order summary is an electronic signature, which has the same value, for both parties, as a handwritten signature. This signature makes the order irrevocable and cannot be cancelled without the Mineral DG agreement.

Any order will be confirmed to the customer by sending an email to the email address that it has provided. It is up to the client to indicate a valid email address.

DG Minerals advises the customer to keep a copy of the order summary until the confirmation email is received.

DG Minerals keeps on reliable and sustainable support orders and invoices made, which can be produced as proof of transaction.

Product information

The potential client has photographs and descriptions to know the essential characteristics of the minerals he chooses. Despite all the efforts devoted to their realization, these photographs and descriptions can only be given as an indication, including the colours of the specimens whose rendering can be modified by the customer's computer equipment.

No jewelry description document can question the validity of an order.

Offers on the Mineral DG site are valid only within the limits of available stocks. In case of stock break or cancellation it will not be awarded any compensation.

Price information

All prices indicated are expressed in euros all taxes included (TTC). In accordance with section 293 B of the CGI, VAT is not applicable.

Prices are indicative and can evolve. They are only valid on the date of the order confirmation.

Prices do not take into account any shipping costs. These will be indicated before the order is validated. Therefore the customer confirming the payment agreement of the order accepts to pay the shipping costs, and these will not be recognized as valid reason for the cancellation of the order.

Any customs charges are borne by the customer.

Upon order, the payment of the entire price of the product(s) as well as any shipping costs must be made. No product will be shipped to the customer if the customer has not paid 100% of the sale price.

Payment methods

The customer can pay his order using the online CB payment secured by Stripe or Paypal.

The customer guarantees to DG Minerals when the order is validated that he has the necessary authorizations to use the payment method he has chosen.

In the event of refusal of payment authorization from officially accredited bodies or in the event of non-payment, DG Minerals reserves the right to suspend any order management and delivery.

In addition, DG Minerals reserves the right to refuse to make a delivery or not to honor an order in the event that the order has not been paid in full, or if the customer would have a payment dispute in the course of administration.

In case of non-payment or fraud DG Minerals reserves the right to prosecute the authors.

Secure payment

To guarantee the customer the best security, card numbers do not pass or are stored on our server. Stripe or Paypal manage the various stages of the transaction (from the acquisition of the transaction to the bank transfer) by a secure exchange protocol encrypting the information.

Conditions of delivery

 

Delivery rates

The delivery rates depend on the delivery address requested by the customer when the order is placed.

For a delivery in metropolitan France, the delivery price is €5.90 and the delivery is offered from €80 per order.

For delivery outside metropolitan France, the price will depend on the weight of the package and on the other hand on the delivery area (more details: page delivery) .

Shipping and delivery time

The shipping time is 3 working days maximum. This period starts from the date of payment of the order and/or certification of the payment.

The delivery deadlines are those indicated by the Post Office, for example:

  • Metropolitan France: 48H

  • DOM TOM (Zone A): 5 to 7 working days

  • DOM TOM (Zone B): 5 to 7 working days

  • International (Zone 1): 3-5 working days

  • International (Zone 2): 4 to 8 working days

  • International (Zone 3): 4 to 8 working days

The customer will be notified by email of the shipment of his order.

In case of force majeure or exceptional events (natural disasters, epidemic, strike, war, etc.) delaying or prohibiting the delivery of goods, DG Minerals cannot be held responsible.

Method of delivery

The delivery is made to the address indicated by the customer during the order. DG Minerals cannot be held responsible if a problem during delivery is due to an address error provided during the order.

The delivery will be carried out by the Post office and will be considered effective from the date of the first submission by the carrier of the goods to the address indicated by the customer (the site of the carrier being declared).

The customer is required to verify the condition of the packaging of the goods and to report any anomaly concerning the delivery (damaged product, grind, etc.). The customer must within two working days after the delivery date confirm this anomaly by sending a registered mail to the carrier setting out his claims. It will have to send a copy of this mail in parallel by simple mail to:

In the event of delay in delivery, loss of goods, or delivery to a bad address of the carrier's fault, DG Minerals is free from any liability and the customer cannot in any case claim a refund or an article (or articles) in compensation.

The customer can get the invoice sent to a different address of the delivery address by validating the option offered when taking the order.

Claims on delivery errors

Any claim for error in the delivery and/or non-conformity of the products in kind or in quality in relation to the indications on the order form must be made on the same day of delivery or no later than the first working day after delivery. Any claim beyond that time limit will be rejected.

Any claims not made under the above rules and within the specified time limits shall not be taken into account and be released DG Minerals of all liability to the client.

Delivery and return costs remain the responsibility of the customer.

Customs

It is up to the customer to be informed about the customs regulations of his own country.

All import fees, duties, VAT or other costs/costs associated with the international shipment are the sole responsibility of the customer.

Mineral DGs cannot be held responsible for damage caused during customs inspections.



Return and Warranty

Right of withdrawal

In accordance with the legislation, the customer has 14 working days to return the product at his or her own expense. This deadline is short from the date of delivery of the product. If this period expires on a Saturday, Sunday or a holiday or a holiday, it is extended until the next working day.

The return of minerals must be made under resistant packages. It must be done with a follow-up number. DG Minerals may not be held responsible for any loss, loss or theft of your return.

In the event that the customer exercises his right of withdrawal, he or she will have the option to request a valid asset for 2 months or a refund (which will be made within 7 days maximum). The shipping will be at the customer's expense.

Only items will be taken over as a whole, in their complete original packaging and in perfect condition of resale. Any product that has been damaged, or whose packaging has been deteriorated, will not be refunded or exchanged.

DG Minerals reserves the right to ask the client to repay documents supporting his identity (identity card and bank statement justifying the purchase).

Warranty

The customer has the legal guarantee against hidden defects (Art. 1641 to 1649 of the Civil Code) and the guarantee of compliance (Art. L. 211-1 to L. 212-14 of the Consumer Code). The guarantee against hidden defects is defined in the normal use of the product. The damage or loss occurring as a result of an accidental circumstance, and wear and ageing are excluded from this warranty.
